ORDINANCE NO. 1913-85 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA, CREATING ARTICLE VIII. ART IN PUBLIC PLACES OF CHAPTER 26 STREETS, SIDEWALKS, AND PUBLIC PLACES OF THE CODE OF ORDINANCES OF THE CITY OF WEST PALM BEACH, FLORIDA, 1979, AS AMENDED; CREATING THE WST PALM BEACH ART IN PUBLIC PLACES COMMITTEE TO COINSIST OF SEVEN (7) MEMBERS WHICH SHALL ADVISE THE CITY COMMISSION ON THE ACQUISITION, COMMISSIONING AND MAINTENANCE OF WORKS OF ART FOR PUBLIC PLACES; DEFINING THE POWERS AND DUTIES OF THE COMMITTEE; PROVIDING A CODIFICAITON CLAUSE, A CONFLICTS CLAUSE AND A SEERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of West Palm Beach acknowledges the important part the arts play in the lives of the residents of and visitors to the City; and WHEREAS, it is deemed by the City Commission to be in the best interests of the City that a committee be established to advise the City Commission on the acquisition, commissioning and maintenance of works of art for public places. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA that: SECTION 1: ARTICLE VIII. ART IN THE PUBLIC PLACES OF Chapter 26 STREETS, SIDEWALKS, AND PUBLIC PLACES of the Code of Ordinances of the City of West Palm Beach, Florida, 1979, as amended is created to read: ARTICLE VIII. ART IN PUBLIC PLACES Sec. 26-151. West Palm Beach Art in Public Places Committee created. There is hereby created the West Palm Beach Art in Public Places Committee to consist of seven (7) members appointed by the City Commission. The first three (3) appointees shall serve a term of one (1) year, the second two (2) appointees shall serve a term of two (2) years, and the last two appointees shall serve a term of three (3) years. Thereafter, all terms shall be for three (3) years. The committee shall designate one of its members to act as chairperson for a term of one (1) year, or until a successor is elected and qualified. The committee shall maintain minutes of all of its meetings. Each member of the committee shall serve without compensation. Sec. 26-152. Powers, duties and functions. As the terms are used below, a “work of art” means the application of skill and taste in the creation of tangible objects according to aesthetic principles including, but not limited to, paintings, sculpture, engravings, carvings, frescos, murals, collages, mosaics, statures, bas-reliefs, tapestries, photographs, drawings and landscape design. “Public place” means any place owned or operated by the City of West Palm Beach including, but not limited to, buildings, parks and open spaces. The West Palm Beach Art in Public Places Committee shall:
The recommendation of the West Palm Beach Art in Public Places Committee to the city Commission shall be advisory only, and may or may not be consistent with similar recommendations made to the City Commission by the West Palm Beach Planning Board and the West Palm Beach Parks and Recreation Board relating to art in public places. SECTION 2: Specific authority is hereby granted to codify this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: Should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. SECTION 5: This ordinance shall become effective immediately upon its passage at second reading. First reading: November 18, 1985
